This Privacy Policy explains how Brokker collects, uses and protects your personal data when you use the Brokker website and mobile application (together, the “Platform”), and what rights you have. It should be read together with our Terms & Conditions.
1. Data controller
The controller of your personal data is TECHNOVA, a French limited liability company (SARL) operating the Brokker brand, registered with the Paris Trade and Companies Register under number 941 404 667, with its registered office at 60 rue François Ier, 75008 Paris, France (“Brokker”, “we”, “us”).
Brokker is the controller for the website, the mobile application and related services. Contracts concluded between Members (sale, lease, mandate) are not concluded with Brokker: each Member is responsible for the data they then process for their own purposes, for example a Broker handling a client file.
2. Data protection contact
Brokker is not required to appoint a Data Protection Officer (DPO). An internal GDPR contact handles all questions and requests relating to your data at contact@brokkerspot.com. We reserve the right to appoint a DPO in the future; this Policy will then be updated.
3. Purposes and legal bases
Providing the Platform — performance of the contract (the Terms):
- creating and managing your account;
- publishing and searching listings;
- messaging between Members and electronic signature of documents.
Communication — performance of the contract and legitimate interest:
- notifications (new messages, signature requests, saved searches);
- service information (account, security, changes to the Terms);
- customer support and complaints.
Marketing — your consent, which you can withdraw at any time:
- newsletters and offers;
- personalised suggestions of listings.
Trust, security and improvement — legitimate interest and legal obligations:
- verification of professional profiles (“verified” badge);
- fraud prevention, moderation and handling of reports of illegal content (Digital Services Act);
- aggregated statistics and crash analysis to improve the Platform;
- retention of connection data and answering lawful requests from authorities.
4. Data we collect
- Identification data: name, email address, phone number, password (stored encrypted), profile photo, account type (private individual or professional).
- Professional data: company name, professional card number, and information or documents provided for profile verification.
- Listings and content: property details, address or location, photos, documents and any other content you publish.
- Messages and signed documents: messages exchanged with other Members, documents sent for electronic signature and signature records.
- Usage and location data: searches, filters, saved listings; your location only if you allow it in your device settings, to show properties near you.
- Technical data and cookies: IP address, device type, operating system, app version, crash and connection logs. Cookies and similar technologies are:
- strictly necessary (login, security, preferences) — no consent required;
- analytics — used with your consent unless exempt under CNIL rules;
- advertising — only with your consent.
- Third-party data: if you sign in with Apple or Google, we receive your name and email address from them.
We do not intentionally collect sensitive data (health, religion, origin, etc.). Please do not include such data in your listings or messages.
5. Recipients
- Brokker's authorised staff, on a need-to-know basis.
- Other users: your listings and public profile (name or company name, photo, professional status, badge) are visible on the Platform; your contact details and messages are shared only with the Members you choose to communicate with.
- Technical providers acting on our instructions under a data processing agreement: hosting and database, email and push notifications, electronic signature, maps, analytics and crash reporting. The list is available on request.
- Apple and Google, as independent controllers, when you download the app from their stores.
- Authorities, only where required by law.
We never sell your personal data.
6. Retention periods
- Account: while active; deleted within 30 days of account deletion, or after 3 years of inactivity, after notice.
- Listings and messages: until deleted, and at the latest with the account.
- Signed documents and signature records: 5 years, for evidence purposes.
- Connection logs: 1 year, as required by French law.
- Cookies: 13 months maximum; consent choices are kept for 6 months.
- Marketing: until you withdraw consent, or 3 years from the last contact for non-members.
Data may be kept longer in archived form where required by law or to establish, exercise or defend legal claims.
7. Your rights
Under the GDPR and the French Data Protection Act, you have the right to access, rectify and erase your data, to restrict or object to its processing (including to direct marketing at any time), to data portability, to withdraw your consent at any time, and to give instructions on what happens to your data after your death.
You can delete your account at any time from the app settings. To exercise your other rights, write to contact@brokkerspot.com. We will reply within one month and may ask for proof of identity if we have reasonable doubt about it.
You may lodge a complaint with the CNIL (3 place de Fontenoy, TSA 80715, 75334 Paris Cedex 07 — www.cnil.fr) or with the authority of your country of residence.
8. Transfers outside the EU
Some of our providers may process data outside the European Economic Area. These transfers are governed by an adequacy decision of the European Commission (including the EU-US Data Privacy Framework) or by the Commission's Standard Contractual Clauses, with supplementary measures such as encryption where needed.
9. Security
We protect your data with encrypted connections (HTTPS/TLS), encrypted password storage, secure backups and strictly restricted access to servers and data. In the event of a data breach, we notify the CNIL within 72 hours where required, and inform you directly if the breach is likely to put your rights at high risk.
10. Consent and transparency
Where processing relies on your consent, it is collected by an explicit action (unticked box, cookie banner, device permission) and recorded. You can withdraw it at any time from the app settings, the cookie banner, the unsubscribe link in each email, or by writing to us.
The Platform is reserved for persons aged 18 or over. We do not knowingly collect data about minors; if you believe a minor has provided us with data, contact us so that we can delete it.
11. Accountability
Brokker keeps a record of processing activities, carries out impact assessments where processing is likely to result in a high risk, documents its internal procedures and checks that its providers offer sufficient guarantees for the protection of your data.
12. Changes to this Policy
We may update this Policy, in particular to reflect changes in the law or the Platform. The date of the last update is shown at the top of this page. Significant changes will be notified to Members by email or in-app notification and, where required, your consent will be requested again.
